WhatSender Pro is a neutral technology provider. Our software is a tool provided for the user's independent use. We do not provide, curate, or monitor the contact lists or the message content sent by our users.

Liability Disclaimer: You acknowledge that you are the sole "sender" of any messages dispatched via the software. WhatSender Pro assumes no responsibility for the content, intent, or legal consequences of your outreach.

PLATFORM INDEMNIFICATION

Should WhatSender Pro face any legal inquiry, claim, or action from Meta Platforms, Inc. (WhatsApp) or any regulatory body due to your misuse of the software, you agree to indemnify and hold us harmless for all damages, losses, and legal costs incurred.

Prohibited Activities

The following activities are strictly prohibited when using WhatSender Pro:

  1. Sending messages to purchased, rented, or third-party phone number lists.
  2. Sending deceptive links, phishing content, or fraudulent offers.
  3. Sending messages to contacts who have not opted-in or have requested to opt-out.
  4. Violating individual local or national privacy and marketing laws (e.g., GDPR, CAN-SPAM).
Data Legality: The user warrants that all contact lists imported into the software have been obtained legally and with required consent. WhatSender Pro does not verify the legality of your data.

Compliance & Best Practices

As a condition of your license, you agree to comply with all applicable international and local laws, including but not limited to GDPR (Europe), CAN-SPAM (USA), and TCPA.

Ethical Duty of Care

Users are required to utilize the software's built-in "Delay between messages" and "Account rotation" features to maintain ethical sending patterns. Failure to use these safety features, resulting in platform-level blocks, is the sole responsibility of the user.

Ethical Compliance Protocol

MANDATORY OPT-OUT: You must include a clear and conspicuous "Unsubscribe" or "Reply STOP" cue in your initial outreach to allow recipients to decline future messages.

Account Termination

If we receive verified reports of spam behavior or illegal outreach via our platform, we reserve the right to terminate your software license immediately without refund.
