We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

EULA & Usage Terms

EULA: By using our software, you agree to abide following terms of usage:

1. License key once activated on a particular machine cannot be used with or transferred to a different machine.
2. No refund shall be provided against your license once activated on a machine.
3. This software will only scrape publicly available information from respective website(s) if and until the website is accessible from your machine. If either of your machine, network or IP is blocked by the respective website(s), it will not be considered as a software failure.
4. If the software fails to work properly at any point of time during your licensed period, you must allow upto 30 days for a fix discovered issue to be fixed.
5. In the event of software failure or discontinuation (due to technical limitations), you can request to convert your license to another offering from our range of software. This can only be availed once.
6. Redistribution of this software (regardless of purpose) is not permitted. Failing to which, your license shall be cancelled immediately.
7. You agree to indemnify us from any liability, obligation or responsibility for any loss or damage whatsoever derived from the usage of this software or obtained information.

Software Nature & Data Protocol

Spam Disclaimer: If the content of the sended messages is unsolicited “garbage” messages, recipients can click ‘Block’ or ‘Report Spam’ which can get your account suspended. WHATSENDER PRO bears no responsibility for the content, reception, or reactions to those messages.

Third-Party Integrations

WHATSENDER PRO offers connectivity with third-party platforms, such as Google APIs, to facilitate specific features like Google Contacts Synchronization.

Your use of these third-party services is subject to their respective terms and privacy policies. By using the Google Sync feature, you agree to comply with Google's Terms of Service and acknowledge that WHATSENDER PRO is an independent tool that utilizes official APIs in compliance with all relevant platform policies.

It is not necessary to register with us in order to use most parts of this Website. However, particular areas of this Website will only be accessible only if you have registered.

Site Availability

All reasonable measures are taken by us to ensure that this Website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

Platform Dependency & API Risks

WHATSENDER PRO is a third-party automation tool that operates on top of the WhatsApp platform. We do not own, control, or have any official affiliation with WhatsApp Inc or Meta.

Service Continuity: You acknowledge that your ability to use WHATSENDER PRO depends entirely on the continued availability of WhatsApp's web servers and APIs. If WhatsApp introduces new security measures, changes its interface, or restricts API access, WHATSENDER PRO may become partially or fully non-functional. Such events are considered Force Majeure and do not entitle the user to a refund.

Account Management

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

You may not use as a username the name of another person or entity that is not lawfully available for use, or any name that is offensive, vulgar or obscene. We reserve the right to refuse service or terminate accounts in our sole discretion.

IP & License Lockdown

You are strictly prohibited from: (a) reverse engineering, decompiling, or disassembling the software; (b) attempting to derive the source code; (c) creating derivative works; or (d) circumventing any activation or licensing mechanisms.

Content & Website Usage

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

By posting Content on or through Service, You represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

Prohibited Uses

In addition to other prohibitions set forth in the Terms, you are prohibited from using the App or its content for:

• (01) Any unlawful purpose or soliciting others to perform unlawful acts.
• (02) Violating international, federal, provincial or state regulations, rules, or laws.
• (03) Infringing upon our intellectual property rights or the rights of others.
• (04) Harassing, abusing, insulting, harming, defaming, slandering, or intimidating based on gender, orientation, religion, or race.
• (05) Submitting false or misleading information.
• (06) Uploading viruses or any other type of malicious code that will affect functionality.
• (07) Collecting or tracking the personal information of others.
• (08) To spam, phish, pharm, pretext, spider, crawl, ransomware attack, or scrape.
• (09) For any obscene or immoral purpose.
• (10) Interfering with or circumventing security features.
• (11) Engaging in WhatsApp Spamming or Unauthorized Automation Messages.

Service & Pricing Modifications

Prices for our services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Operations, Fees & Refunds

Refund Conditions

Given the nature of the product i.e., a software that helps you send messages to your audience which works rights from the start of your license, no refunds shall be provided once the license key is activated and use or purchase. In international purchase, whether the License is activated or non-activated, no refunds shall be provided.

Refund Limitations

No refunds shall be given in case any of the client's WA number got blocked by their respective service provider or the target audience. This completely depends on the use case.

FURTHERMORE, IF THE PROGRAM NO LONGER WORKS DUE TO NEW BLOCKING / SECURITY MEASURES OR UPDATES OF WHATSAPP PLATFORM, YOU ARE NOT ENTITLED TO RECEIVE ANY REFUND.

Liability Matrix & Indemnity

THESE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". COMPANY MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES.

User Indemnification

Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Exclusive Jurisdiction: Any dispute arising in connection with these terms of use shall be subject to the exclusive jurisdiction of the Courts of New Delhi, India.
