Cyber Law & IPC Compliance

This Cyber Law & Criminal Compliance Policy ("Cyber Compliance Policy") explains how WHATSENDER PRO operates under Indian cyber law, information technology regulations, and applicable criminal statutes — and sets out the lawful-use obligations of every customer, visitor, reseller, and end user of our services.

This policy applies to: (a) the whatsenderpro.com website and subdomains; (b) WhatSender Pro Windows desktop software; (c) the WhatSender Pro Chrome browser extension; (d) free browser-based tools; (e) license activation, billing, and support services; and (f) any future products published by WHATSENDER PRO.

This Cyber Compliance Policy forms part of our legal framework together with the Terms of Service, Privacy Policy, Anti-Spam Policy, and License Agreement. In the event of conflict, the Terms of Service prevail unless mandatory law requires otherwise.

WHATSENDER PRO is an independent software publisher. We are not WhatsApp Inc., Meta Platforms, Inc., or any telecommunications carrier. We provide licensed software and related web services that run primarily on the user's own device.

We do not initiate, compose, approve, schedule, or deliver WhatsApp messages on behalf of users. We do not supply contact databases, leads, or verified opt-in lists. Message content, recipient selection, timing, and compliance are under the sole control and responsibility of the user.

Use of WHATSENDER PRO must comply with the Information Technology Act, 2000 ("IT Act"), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"), the Digital Personal Data Protection Act, 2023 ("DPDP Act"), and rules, notifications, and directions issued under them, including CERT-In directions where applicable.

Section 43 — Damage to computer resources

You must not use WHATSENDER PRO to access, alter, delete, disrupt, or destroy any computer, computer system, or data without authorization. This includes introducing malware, ransomware, unauthorized scraping overload, or denial-of-service patterns.

Section 66 — Computer-related offences

Dishonest or fraudulent acts involving computer resources — including unauthorized access, data theft, or impairment of systems — are strictly prohibited. Violations may result in immediate license termination and referral to authorities.

Section 66C — Identity theft

Impersonating another person, brand, government body, or WhatsApp/Meta official using digital means is prohibited. You must not use false caller IDs, forged business names, or stolen credentials.

Section 66D — Cheating by personation

Phishing, fake prize scams, investment fraud, romance scams, or any deceptive communication sent via computer resource is prohibited. WHATSENDER PRO must not be used to mislead recipients for financial gain.

Section 66E — Violation of privacy

Capturing, publishing, or transmitting private images or recordings without consent — including through call-recording or screen-capture features — is prohibited where unlawful.

Section 66F — Cyber terrorism

Any use threatening the unity, integrity, security, or sovereignty of India, or designed to cause terror or disruption of critical infrastructure, is absolutely prohibited and will be reported immediately.

Sections 67, 67A, 67B — Obscene & harmful content

Publishing or transmitting obscene material, sexually explicit content, or child sexual abuse material (CSAM) through any channel enabled by the software is strictly forbidden. We maintain zero tolerance and will cooperate with law enforcement.

Sections 72 & 72A — Confidentiality breach

You must not disclose personal information obtained through the software in breach of lawful contract, privacy notices, or applicable law. Exported contacts, chat logs, and recordings must be handled securely.

Section 65 — Tampering with computer source code

Altering, concealing, destroying, or publishing source code of WHATSENDER PRO, license files, activation modules, or related systems without authorization is prohibited and may constitute a criminal offence. Reverse engineering, cracking, or distributing modified builds is a material breach.

Section 67C — Intermediary data retention

Where WHATSENDER PRO qualifies as an intermediary, we may retain and disclose information as required by law, government orders, or CERT-In directions. Users must not attempt to obstruct lawful preservation or disclosure obligations.

Sections 69, 69A & 69B — Lawful directions

WHATSENDER PRO will comply with lawful interception, monitoring, decryption, blocking, and information-collection directions issued under the IT Act. Users have no right to demand that we refuse valid legal process.

Sections 70 & 70B — Protected & critical systems

You must not use WHATSENDER PRO to attack, probe, disrupt, or gain unauthorized access to protected systems, national critical information infrastructure, government networks, or third-party infrastructure.

To the extent WHATSENDER PRO qualifies as an "intermediary" under Section 79 of the IT Act for website hosting, license services, or limited technical functions, we rely on the statutory framework that intermediaries are not liable for third-party content or user-generated data when due diligence obligations are met.

Because WhatsApp message content, contact lists, and most operational data remain on the user's device and are not hosted by WHATSENDER PRO as message content, users acknowledge that WHATSENDER PRO does not exercise editorial control over messages sent through the software.

• We publish this Cyber Compliance Policy, Terms of Service, Privacy Policy, and Grievance Officer details as part of IT Rules 2021 due diligence.
• We act on valid legal orders, court directions, and good-faith abuse reports within reasonable timeframes.
• We may remove access, suspend licenses, or terminate accounts upon knowledge of unlawful use.
• We do not proactively monitor private message content on user devices; our visibility is limited to website interactions, license records, support tickets, and data users voluntarily submit.

In addition to the IT Act, users must comply with the Indian Penal Code, 1860 ("IPC") where still applicable, and the Bharatiya Nyaya Sanhita, 2023 ("BNS") and related criminal laws. The following categories of conduct are expressly prohibited when using WHATSENDER PRO services:

Cheating & fraud (IPC §420 / BNS cheating provisions)

Deceiving recipients to deliver property, money, OTPs, passwords, or personal data — including lottery scams, fake job offers, crypto fraud, and impersonation of banks or government agencies.

Forgery & falsification (IPC §§463–469 / BNS forgery provisions)

Creating or using forged documents, fake invoices, counterfeit certificates, or falsified identity materials distributed via WhatsApp or email integrations.

Defamation (IPC §§499–500 / BNS defamation provisions)

Broadcasting false statements harming reputation of individuals or businesses. Bulk defamatory campaigns are prohibited.

Criminal intimidation & threats (IPC §§503–507 / BNS intimidation provisions)

Threatening harm, extortion, blackmail, or anonymous intimidation through messaging, calls, or recordings.

Extortion (IPC §§383–389 / BNS extortion provisions)

Demanding money or advantage under threat of exposing information, harming reputation, or releasing private data.

Stalking & harassment (IPC §354D / BNS stalking provisions)

Repeated unwanted contact, monitoring, or harassment after a recipient has blocked, opted out, or requested cessation.

Insult & sexual harassment (IPC §509 / BNS related provisions)

Sending obscene words, images, or gestures intended to insult or harass recipients.

Criminal conspiracy & abetment (IPC §§120B, 107–109 / BNS conspiracy & abetment)

Planning, coordinating, or assisting bulk fraud, phishing, harassment, or unlawful campaigns — including operating reseller networks for cracked licenses — is prohibited.

Criminal breach of trust (IPC §405 / BNS breach of trust)

Misusing customer data, contact lists, payments, or entrusted business information obtained through WHATSENDER PRO for personal gain or unauthorized disclosure.

Mischief & damage to property (IPC §§425–427 / BNS mischief)

Destroying, corrupting, or impairing data, devices, or systems belonging to others through malware links, destructive scripts, or deliberate overload.

Copyright & trademark infringement (Copyright Act / Trade Marks Act)

Distributing pirated media, counterfeit goods, or brand-impersonation materials via bulk messaging is prohibited. WHATSENDER PRO is not liable for user-distributed infringing content.

Money laundering & terror financing (PMLA / UAPA where applicable)

Using outreach tools to solicit illicit funds, layer transactions, evade sanctions, or finance unlawful organizations is strictly forbidden.

The following uses of WHATSENDER PRO are strictly prohibited and constitute material breach of our Terms:

1. 01 Unauthorized access to accounts, devices, APIs, or data belonging to third parties.
2. 02 Distribution of malware, spyware, ransomware, or malicious links through any messaging channel.
3. 03 Phishing, vishing, smishing, OTP theft, or credential harvesting.
4. 04 Bulk unsolicited commercial messages without documented consent (see Anti-Spam Policy).
5. 05 Political mass messaging without lawful authorization and consent where required.
6. 06 Sale or promotion of illegal goods, drugs, weapons, counterfeit products, or unlicensed gambling.
7. 07 Hate speech, incitement to violence, or content threatening national security.
8. 08 Child exploitation material or grooming communications — zero tolerance.
9. 09 Circumventing license protection, reverse engineering, or reselling cracked copies.
10. 10 Using free tools or software to harvest numbers for spam or fraud campaigns.
11. 11 Intercepting communications without lawful authority or required consent.
12. 12 Money laundering, terror financing, or sanctions-evasion schemes conducted via outreach.

Users in India must comply with Telecom Regulatory Authority of India (TRAI) regulations for commercial communications, including DND/NCPR registry rules, registered telemarketer requirements, and applicable SMS/voice norms where outreach uses telephony integrations (e.g., Twilio).

International users must comply with equivalent laws such as GDPR, CAN-SPAM, TCPA, CASL, and local electronic marketing rules.

• Maintain proof of opt-in consent and honour DND preferences.
• Identify your business clearly in every outreach message.
• Provide functional opt-out mechanisms and suppress opted-out numbers permanently.
• Do not use personal WhatsApp accounts for regulated commercial telemarketing where business API is required.

You agree to indemnify, defend, and hold harmless WHATSENDER PRO, its directors, officers, employees, agents, and affiliates from and against any and all claims, investigations, penalties, fines, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

• Your violation of the IT Act, IT Rules, DPDP Act, IPC, BNS, or any other applicable law.
• Cyber offences or criminal conduct committed using WHATSENDER PRO.
• Messages, recordings, media, or data you send, store, export, or process through the Service.
• Claims by recipients, Meta/WhatsApp, carriers, regulators, or data protection authorities.
• Failure to obtain consent, privacy notices, or lawful basis for processing personal data.
• Chargebacks, fraud, or payment disputes linked to your account or reseller activity.

We may investigate credible reports of abuse, fraud, or unlawful activity associated with a license, email, payment method, or IP address.

Upon confirmation or reasonable suspicion of violation, we may immediately suspend or permanently revoke licenses, block purchases, invalidate activation keys, and preserve relevant records.

• Cooperate with Indian cyber crime cells, police, courts, CERT-In, and other competent authorities.
• Respond to lawful orders under Section 69B (monitoring and collection) and Section 91 CrPC/BNSS information requests when legally valid.
• Share transaction, license, support, and technical logs necessary for investigation — to the extent in our possession and permitted by law.
• Report child safety concerns and CSAM to appropriate authorities without delay.
• Permanently ban repeat offenders from all WHATSENDER PRO products and services.

If you believe WHATSENDER PRO is being used for cyber crime, fraud, harassment, or other illegal activity, report it with as much detail as possible:

• Sender phone number, WhatsApp profile, or business name.
• Screenshots, message content, links, and timestamps.
• License key or purchase email if known.
• Description of the offence (fraud, threats, spam, impersonation, etc.).
• Your contact details for follow-up.

All purchases on whatsenderpro.com are subject to this Cyber Compliance Policy, Terms of Service, Refund Policy, and License Agreement. By completing checkout — via PayPal, Stripe, Cashfree, Razorpay, bank transfer, or any other offered method — you represent that payment details are accurate, authorized, and not obtained through fraud.

License keys are delivered electronically and bind to the machine where first activated unless WHATSENDER PRO approves a discretionary transfer under separate written terms. One license generally equals one Windows PC unless your plan explicitly states otherwise.

WHATSENDER PRO may decline, cancel, or reverse transactions suspected of fraud, chargeback abuse, stolen payment instruments, sanctions violations, or resale without authorization.

• Providing false identity, billing address, or business details during purchase is prohibited.
• Sharing, publishing, or reselling license keys without written authorization is prohibited.
• Attempting to activate a license on more machines than permitted constitutes breach and may trigger revocation without refund.
• International purchases are final once issued; refund rules are governed by our Refund Policy.

An activated WHATSENDER PRO license is bound to the hardware profile of the PC where it was first validated. You do not have an automatic right to transfer, reset, reissue, or move a license to another computer.

If your PC is stolen, formatted, replaced, damaged, or otherwise unavailable, you are not entitled to a free replacement license. Your remedies are limited to purchasing a new license or requesting discretionary transfer approval through official support channels.

WHATSENDER PRO may, in its sole and absolute discretion, approve a one-time transfer or reactivation. If approved, a non-refundable administrative fee equal to ninety percent (90%) of the original license purchase price applies. Denial of a transfer request does not entitle you to refund, credit, or damages.

1. 01 Submit transfer requests only through official support with valid proof of purchase and license ownership.
2. 02 Do not attempt to bypass machine binding, clone activation tokens, or use cracked loaders.
3. 03 Resellers and agencies must not promise free transfers or lifetime multi-device rights unless expressly authorized in writing by WHATSENDER PRO.
4. 04 Licenses terminated for cyber law, spam, or Terms violations cannot be transferred, reactivated, or refunded.

WHATSENDER PRO desktop software operates primarily on your local Windows PC. WhatsApp sessions, contact databases, campaign content, chat exports, recordings, and most operational files remain under your control on your device unless you voluntarily enable cloud-connected features.

For website accounts, license activation, billing, support tickets, fraud prevention, and optional extension features, WHATSENDER PRO processes limited personal data as described in our Privacy Policy. For recipient and customer data processed through the software, you are the Data Fiduciary or data controller.

You warrant that you have lawful authority, notice, and consent — where required — before importing, storing, messaging, recording, exporting, or profiling any personal data through WHATSENDER PRO.

• You are solely responsible for securing your PC, backups, exported CSV files, API keys, and access credentials.
• WHATSENDER PRO is not liable for data loss caused by hardware failure, malware on your machine, unauthorized access to your PC, or WhatsApp account restrictions.
• You must implement reasonable security measures and delete or anonymize data when no longer required by law or contract.
• Cross-border transfers of personal data by you — not by WHATSENDER PRO as software publisher — are your compliance obligation.
• We may process activation logs, IP addresses, payment metadata, and abuse reports to protect our services and comply with law.

WHATSENDER PRO, its logos, website content, software binaries, extension packages, documentation, and marketing materials are protected by copyright, trademark, and trade secret laws. All rights not expressly granted are reserved.

You may not copy, modify, translate, decompile, disassemble, reverse engineer, or create derivative works of the software except where mandatory law expressly permits and only after prior written notice to WHATSENDER PRO.

1. 01 Distributing cracked, nulled, patched, or unauthorized copies of WHATSENDER PRO is prohibited.
2. 02 Removing license checks, watermarks, or copyright notices is prohibited.
3. 03 Scraping our website, pricing, or documentation for competing clone products may violate IT Act and copyright laws.
4. 04 Using our brand name, logos, or screenshots in misleading ads or impersonation schemes is prohibited.

If you dispute a valid charge through your bank or payment provider without first contacting WHATSENDER PRO support, we may treat the dispute as material breach. We may immediately revoke associated licenses, block future purchases, and preserve transaction evidence for recovery proceedings.

Friendly fraud, false non-delivery claims, and repeated chargeback abuse may be reported to payment processors, cyber crime authorities, and collections agencies where permitted by law.

• Contact support before initiating chargebacks for license delivery or activation issues.
• Provide truthful statements to banks and payment gateways regarding product delivery and usage.
• Indemnify WHATSENDER PRO for losses, fees, and penalties caused by your fraudulent payment disputes.

WHATSENDER PRO is not affiliated with, endorsed by, or sponsored by WhatsApp, Meta, Google, Twilio, OpenAI, or other third-party platforms. You must comply with each provider's terms, commerce policies, and API rules independently.

Account bans, number blocks, template rejections, API suspensions, conversation charges, and quality rating penalties imposed by third parties are your sole responsibility. WHATSENDER PRO does not guarantee uninterrupted WhatsApp access or approval of any campaign.

Free tools on whatsenderpro.com (link generators, QR builders, validators, formatters, and similar utilities) run primarily in your browser. We do not store your pasted numbers, message text, or generated outputs on our servers unless a specific tool states otherwise.

You must not use free tools to generate spam links, phishing QR codes, fraudulent click-to-chat funnels, or unlawful bulk-harvesting workflows. Automated scraping of our free tools or circumvention of rate limits is prohibited.

WHATSENDER PRO services and software are provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted error-free operation.

You may not assign, sublicense, or transfer your rights under this policy or your license without WHATSENDER PRO's prior written consent. WHATSENDER PRO may assign its rights and obligations to affiliates or successors without your consent.

Provisions relating to prohibited use, indemnity, limitation of liability, governing law, data responsibility, intellectual property, and enforcement survive termination of any license or account.

Processing of personal data by WHATSENDER PRO as a Data Fiduciary for customer accounts is governed by our Privacy Policy and DPDP Act compliance sections in the Terms of Service. Under Section 4 and Section 5 of the IT Act (legal recognition of electronic records and digital signatures), your purchase, license activation, website acceptance banners, and continued use of WHATSENDER PRO constitute valid electronic agreement to this Cyber Compliance Policy.

We may update this policy to reflect changes in law or service scope. Material updates will be posted on whatsenderpro.com with a revised effective date. Continued use after updates constitutes acceptance.

This Cyber Compliance Policy is governed by the laws of India. Subject to mandatory consumer protections and the dispute resolution clauses in our Terms of Service, courts at New Delhi, India shall have exclusive jurisdiction over disputes relating to this policy.
